In addition to the
previous misappropriation of the property of our business name and domains
in my name and that of several Sony products, today we learned that Gary Kleiner
stole video clips from us when we'd contracted him to do a few VASST training
dates during a Vegas 5 training tour. Gary was using our computers, our
hard drives on the tour.
A member of the DVInfo.net forums informed us that Gary had posted a tutorial
clip that copies one we'd done back in 2003, and written a tutorial for back in
2002. Indeed, we visited the DVInfo.net post, and found that Gary had not only
plagiarized both written and videotaped tutorials, he did it almost word for
word, text for text, and clip for clip.
In viewing the streamed media tutorial, we discovered that he'd used footage licensed to VASST by Artbeats. In a phone call to Gary, he admitted having taken the clips, and took the position of "so what?"
Well, the "so-what?" is that the clips are licensed to us, they don't belong to us. They were taken from our hard drives without permission, which is bad enough. Gary Kleiner then used those clips in his training DVDs, and sells them. That puts a completely different spin on things. It's bad enough to steal the clips, but it's a very big deal that they were used in a replicated/duplicated product or broadcast, because the stolen clips didn't belong to VASST in the first place. They belong to Artbeats. You can be assured Artbeats is interested in protecting their copyright; they work hard to bring high quality video to the industry, video used by major motion pictures, HBO, CNN, ABC Nightline, Showtime, Discovery Channel, and a lot of other high-end users.

Once the "so-what" was explained to Gary, he
then took the position that "Spot said I could use these clips anywhere."
Not so. In fact, I wasn't aware Gary even had the clips.
Gary's tune changed in a matter of minutes once all of the above was explained
to him; his position became that he was told
by VASST that "Using the clips was a perk of being on the VASST tour as a
trainer."
Not so. We never allow our hard drives to be accessed for this very reason. We
virtually always have Betaware, copyrighted works, broadcast pieces, etc for
purposes of training. We keep these fairly well protected, but obviously not
well enough.
